Terms of Service

1. Acceptance of Terms

By accessing or using MonaFlow ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Description of Service

MonaFlow is a web-based tool that helps skilled trades professionals (plumbers, electricians, HVAC technicians, and similar) create quotes, manage jobs, generate invoices, and manage client information.

Purchases through our Service are processed by Lemon Squeezy Inc., which acts as the Merchant of Record. Lemon Squeezy is the legal seller of our subscription products, not MonaFlow directly.

3. Account Registration

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 18 years old to create an account.
• You may not create accounts using false information or for unlawful purposes.

4. Subscription and Payment

4.1 Plans and Pricing

MonaFlow offers paid subscription plans. Current pricing is available at monaflow.com/pricing. We reserve the right to change pricing with 30 days' notice.

4.2 Free Trial

We may offer a 14-day free trial. At the end of the trial, your subscription will automatically begin unless you cancel before the trial ends.

4.3 Billing

• Subscriptions are billed in advance on a monthly or annual basis.
• All payments are processed by Lemon Squeezy (Merchant of Record).
• Prices are in USD unless otherwise stated.
• Applicable taxes (VAT, GST, sales tax) are calculated and collected by Lemon Squeezy.

4.4 Refund Policy

We offer a 30-day money-back guarantee on new subscriptions. If you are not satisfied within the first 30 days, contact support@monaflow.com for a full refund. After 30 days, refunds are issued at our discretion.

4.5 Cancellation

• You may cancel your subscription at any time from your account settings.
• Cancellation takes effect at the end of the current billing period.
• We do not provide partial refunds for unused portions of a billing period.
• Annual subscriptions: cancellation takes effect at the end of the annual period. No partial-year refunds after the 30-day money-back period.

6. User Responsibilities

You agree to:

• Use the Service only for lawful business purposes
• Maintain the accuracy of all information you enter (license numbers, tax rates, business details)
• Comply with all applicable laws, regulations, and licensing requirements in your jurisdiction
• Not use the Service to generate fraudulent or misleading documents
• Not attempt to reverse-engineer, decompile, or compromise the Service

7. Intellectual Property

• MonaFlow and its original content, features, and functionality are owned by MonaFlow and are protected by international copyright, trademark, and other intellectual property laws.
• Your business data, invoices, and client information remain your property.
• You grant us a limited license to process and store your data solely to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described therein.

9. Limitation of Liability

9.1 To the Maximum Extent Permitted by Law:

• The Service is provided "AS-IS" and "AS-AVAILABLE" without warranties of any kind, express or implied.
• We do NOT warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.
• We are NOT liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9.2 Specific Limitations

• We are NOT liable for any losses resulting from invoices that are inaccurate, non-compliant, or incomplete. You are responsible for verifying the accuracy and legal compliance of all documents you generate.
• We are NOT liable for any tax obligations, penalties, or interest arising from your use or misuse of the Service.
• We are NOT liable for any business decisions you make based on information provided by the Service.
• Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MonaFlow from any claims, damages, losses, or expenses (including attorney's fees) arising from:

• Your use or misuse of the Service
• Documents (including invoices) you generate that violate any law or regulation
• Your failure to comply with applicable licensing, tax, or regulatory requirements
• Any dispute between you and your clients related to documents generated through the Service

11. Termination

• We may suspend or terminate your account if you violate these Terms.
• You may terminate your account at any time by contacting us or deleting your account.
• Upon termination, your right to use the Service ceases immediately.
• Provisions that by their nature should survive termination shall remain in effect (Sections 5, 9, 10, and 12).

12. Governing Law and Dispute Resolution

• These Terms are governed by the laws of the United States.
• Any disputes shall be resolved through binding arbitration under the rules of a mutually agreed arbitration body.
• You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email notification to your registered address, prominent notice on our website, and updating the "Effective Date" at the top. Continued use after changes constitutes acceptance.
